Course completion is education. It does not promise a court outcome or permission to carry concealed.

Finding out you have been charged with carrying a concealed weapon can be stressful. You may be replaying the encounter, worrying about your court date, or wondering how this could affect your family, your job, and your future.

Take a breath. You do not have to figure everything out at once—but the steps you take next deserve careful attention.

At Virginia Tactical Shooting Academy and Commonwealth Training & Preparedness Group, we believe firearm education should come with understanding, not judgment. Whether you are new to firearms or have owned one for years, you deserve clear information and a welcoming place to learn.

Here is where to begin, what to discuss with your attorney, and why you should make Firearm Safety / Virginia Concealed Carry training part of your next steps. This guide serves readers in Richmond, Henrico, Sandston, Hanover, Mechanicsville and Short Pump; the charge and court handling your case determine the legal questions to discuss with counsel.

First, Remember: A Charge Is Not a Conviction

Being charged means you have been accused of an offense. It does not mean a court has found you guilty. At trial, the government must prove the charge beyond a reasonable doubt. Do not assume the outcome has already been decided. Congress.gov

Virginia’s primary concealed-weapon law is Virginia Code § 18.2-308. An ordinary first offense is a Class 1 misdemeanor, which can carry up to 12 months in jail, a $2,500 fine, or both. Those are the maximum possible penalties—not an automatic sentence. Repeat offenses can be felonies. Virginia Law

The circumstances matter. A valid concealed handgun permit at the time of the incident, the location of the handgun, and statutory exceptions can affect the case. For example, Virginia law contains an exception for an eligible person’s handgun secured in a container or compartment in a personal, private vehicle. Virginia Law

Start with the exact charge on your paperwork—not someone else’s experience with a similar situation.

Speak With an Attorney Before Making Decisions About Your Case

Your first priority should be speaking with a Virginia criminal-defense attorney, preferably someone familiar with firearm cases in the court handling your charge.

Bring your summons or warrant, release paperwork, and any permit that was valid when the incident occurred. Ask the attorney to review the evidence, explain possible defenses, and help you understand your options before deciding how to plead.

When the cost of representation is a concern, ask the court whether you qualify for appointed counsel. Eligibility depends on your financial circumstances and the applicable legal requirements. Virginia Law

Be careful about trying to explain your way out of the situation through additional police interviews. During custodial questioning, you have the right to remain silent and request an attorney. A clear way to express that is: Congress.gov

“I am choosing to remain silent. I want an attorney before answering questions about this incident.”

Keep detailed discussions about the case between you and your attorney rather than posting your account online or sharing it in a classroom.

Get Organized and Follow Every Court Instruction

When you are anxious, even basic paperwork can feel overwhelming. Start by putting everything in one folder: your charging documents, court notices, release conditions, permit information, and any property receipt for items police took.

Write down what you remember for your attorney. Save relevant photographs, messages, and recordings without changing or deleting them. Ask your attorney about preserving police video or other evidence that may help explain what happened.

Confirm your court date, time, and location. Arrange transportation and time away from work in advance. Willfully failing to appear can create an additional criminal charge. When an emergency arises, contact your attorney and the court immediately rather than simply missing the hearing. Virginia Law

Also read your release conditions carefully. A judicial officer can restrict firearm possession while a case is pending, even before a conviction. An existing permit does not override that restriction. Have your attorney clarify anything you do not understand before possessing, carrying, or attempting to retrieve a firearm. Virginia Law

You do not need to solve the entire case today. Focus on getting legal help, protecting your records, and following the court’s instructions.

Take a Firearm Safety / Concealed Carry Class as Your Next Step

Along with getting legal representation, you should make firearm safety education part of your next steps. We recommend completing our Firearm Safety / Virginia Concealed Carry Class before court, provided your attorney confirms that the course is appropriate for your situation and your release conditions allow participation.

Use this opportunity to strengthen your understanding of firearm safety, Virginia firearm laws, and the responsibilities that come with carrying.

Our course provides a Certificate of Completion to students who successfully complete the training. Give a copy to your attorney and discuss whether it should be presented during negotiations as documentation of your efforts to become better informed. Your attorney should decide whether and how that documentation fits your case. Commonwealth Training & Preparedness

Before enrolling for a court-related purpose, have your attorney review the course description and confirm whether any particular format, instructor qualifications, or completion documents are required.

Take a constructive step forward: confirm participation with your attorney, then register for class.

Understand What Training Can—and Cannot—Do

Education should complement your legal representation, not replace it.

Virginia law allows a deferred disposition with the agreement of the defendant and prosecutor and approval of the court. In simple terms, the court postpones the final outcome while specified conditions are addressed. Depending on the arrangement, the eventual result can include dismissal, conviction of a different charge, or conviction of the original charge. The law does not establish an automatic “take a firearm safety class and receive a dismissal” rule. Virginia Law

Your attorney can evaluate whether voluntary training is appropriate to propose during negotiations. Do not assume a course satisfies a court requirement until the specific requirements have been confirmed.

Taking a class or obtaining a permit afterward also does not make earlier concealed carry lawful. The statutory handgun-permit defense concerns a valid permit at the time of the alleged offense, not one obtained later. Virginia Law

Our recommendation is to invest in your education while your attorney handles your legal strategy. We do not promise dismissal, a reduced charge, or a particular sentence.

Learn With People Who Want You to Understand—Not Feel Embarrassed

You should not feel uncomfortable asking questions about firearm safety or Virginia law.

At Virginia Tactical Shooting Academy and Commonwealth Training & Preparedness Group, we want you to feel welcome, respected, and comfortable learning. You do not need to explain your pending case to the class. Come ready to learn, ask general questions, and build your understanding.

Our Virginia Concealed Carry Class, provided by Commonwealth Training & Preparedness Group, is a beginner-friendly, in-person classroom course. No previous firearms experience or training is required. Instruction covers firearm safety, responsible handgun ownership, concealed-carry considerations, Virginia firearm laws, prohibited locations, interactions with law enforcement, safe storage, and transportation. Commonwealth Training & Preparedness

Our goal is not simply to help you complete a class. We want you to leave better prepared to make informed decisions about firearm ownership and the responsibilities that come with it.

Keep Your Training Certificate—and Know What It Means

After successful completion, keep your certificate with your important records and provide a copy to your attorney when requested.

A training certificate is not a concealed handgun permit. Qualifying in-person training can satisfy the handgun-competency portion of a Virginia resident’s permit application, but eligibility and permit issuance are separate matters. Do not treat a class certificate as permission to carry concealed. Virginia Law

Before attending, confirm with your attorney that your release conditions allow the planned participation. Tell our team about any restrictions affecting your attendance or activities without sharing unnecessary details about your case.

Review the course preparation instructions before arriving. Bring your government-issued photo identification, something for taking notes, and a willingness to learn. Commonwealth Training & Preparedness
